Terms of service

1. Acceptance of terms

These Terms of Service (“Terms”) are an agreement between you and Apocalypse Technologies (“we”, “us”, “our”), which owns and operates Actrone (“Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including those accessing the Service on behalf of a company or other legal entity.

2. Description of service

Actrone is infrastructure software for AI agents. It includes a hosted orchestration platform, open source libraries, SDKs, and a web-based control interface (“Control Tower”). The open source components are licensed separately under the MIT Licence. These Terms govern the hosted platform and any related commercial services.

3. Account registration

You must register for an account to use the hosted platform. You agree to provide accurate, complete information and to keep your account credentials confidential. You are responsible for all activity under your account. Notify us immediately at security@actrone.com if you suspect unauthorised access.

4. Acceptable use

You agree not to use the Service to: (a) violate any applicable law or regulation; (b) transmit or process data that you do not have the right to use; (c) attempt to gain unauthorised access to any system or network; (d) interfere with or disrupt the Service; (e) use the Service to train models or develop competitive products without our written consent; (f) circumvent usage limits or billing controls. Violation of these terms may result in immediate account suspension.

5. Fees and payment

Fees for paid plans are described on our Pricing page and may be updated with 30 days notice. You authorise us to charge your payment method on the billing cycle associated with your plan. Overdue invoices may result in service suspension. All fees are exclusive of taxes, which you are responsible for.

6. Data and privacy

Your use of the Service is also governed by our Privacy Policy. Task inputs, outputs, and metadata are processed to deliver the Service. We do not use your data to train shared models without your explicit consent. You retain ownership of all data you submit. For data processing under GDPR or equivalent regulations, see our Data Processing Agreement.

7. Intellectual property

Apocalypse Technologies retains all right, title, and interest in the hosted platform, including all software, interfaces, and documentation. Open source components are licensed under the MIT Licence. You retain all rights to data you submit and output your agents generate.

8. Service level agreement

Uptime commitments and credits for downtime are defined in the Service Level Agreement, which applies to Scale and Enterprise plans. The Core and Pro plans are provided on a best-efforts basis without SLA commitments.

9. Limitation of liability

To the maximum extent permitted by law, Apocalypse Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amounts paid by you in the 12 months preceding the claim.

10. Modifications

We may modify these Terms with 30 days written notice. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. Material changes will be communicated by email to the address on your account.

11. Governing law

These Terms are governed by the laws of the jurisdiction in which Apocalypse Technologies is incorporated, without regard to conflict of law principles. Any disputes shall be resolved by binding arbitration, except where prohibited by applicable law.
